LTO-CAR told to deputize local traffic enforcers

City officials requested the Cordillera office of the Land transportation Office – Department of transportation (LTO-DOTr-CAR) to conduct appropriate training seminars to deputized local traffic enforcers such as barangay tanods, personnel of the City Public Order and Safety Division (POSD), traffic enforcers, policemen and others on the implementation of traffic laws and confiscation of license plates and driver’s licenses in the city.

Under Resolution No. 622, series of 2022, local legislators stated that during a recent deliberation, lawyer Krystel Grace V. Sanchez representing DOTr-LTO-CAR regional director Francis Ray Almora manifested that with regard the confiscation of driver’s licenses together with the license plates number of motor vehicles by LTO personnel, this has been reiterated under Memorandum dated 14 September 2022 of the Department of the Interior and Local government (DILG) entitled ‘Reiteration of Pertinent Provisions on road Safety and Transportation which State that T Continuously Ensure Compliance to Laws and Policies, Particularly on road Safety and Transportation, the following provisions of the DILG-DOTC Joint t Memorandum Circular No. 01, series of 2008, with subject, Guidelines in the Review of Local Ordinances, Orders, Rules and Regulations concerning Public Transportation is hereby reiterated.’

On the issuance of traffic citation tickets, local government units can issue traffic citation tickets but only the LTO and their deputized agents can confiscate driver’s licenses.

Earlier, the LTO-CAR stipulated that it is deputizing traffic enforcers from local governments provided that they were able to undergo the required trainings for their deputation as traffic enforcers for them to be authorized to confiscated driver’s licenses and license plate numbers of motor vehicles that have violated existing land transportation laws, rules and regulations.

Republic Act (RA) 4136 otherwise known as the land Transportation code of the Philippines mandates the LTO to be the sole agency that can deputize traffic enforcers aside from its existing deputized traffic enforcers to strictly enforce land transportation laws, rules and regulations. – Dexter A.
